The ex-lawyer for the former president has resigned as New Jersey's top federal prosecutor. This decision was prompted by a legal ruling that questioned her eligibility to hold the office.

Acceptance of Resignation

The head of the Justice Department, the Attorney General, accepted her stepping down on Monday. She commented that the judicial decision made it unworkable for her to perform her duties.

"Let no one confuse compliance for surrender," Habba stated. "This battle will now extend throughout the country."

Court Ruling

Her resignation was triggered by a US appeals court ruled that she had been acting without proper authority as US attorney. This decision is likely to affect scores of prosecutions in the Garden State.

The court ruled that a acting appointment that bypassed confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.

Ongoing Legal Battle

The Attorney General added that the former prosecutor will continue working within the DOJ as a top consultant. They intend to pursue additional appeals of the disqualification, with hopes of a overturned decision.

On a social media platform, Bondi argued that the judiciary "cannot be permitted to override the President's choice of prosecutors entrusted with carrying out the executive branch's core responsibility of enforcing the law."

Habba, originally became part of Donald Trump's lawyers in recent years. She went on to defended the former president in his business records case in New York last year, leading to his conviction on multiple felony counts of falsifying business records.

Prior to Habba took on the federal prosecutor position, Trump had announced he was appointing her as his presidential counsellor if re-elected, labeling her as deeply loyal and a "tireless advocate for justice".
